Nintendo has recently updated its Content Guidelines, implementing stricter rules for online content creators featuring its games. These changes could lead to significant repercussions, including permanent bans from sharing Nintendo-related content.

Nintendo's revised "Game Content Guidelines for Online Video & Image Sharing Platforms," effective September 2nd, expand enforcement capabilities. Beyond DMCA takedowns for unlawful content, Nintendo can now proactively remove violating content and restrict creators from future uploads. This represents a significant shift from previous policies, which only addressed "unlawful, infringing, or inappropriate" material.

The updated guidelines clarify prohibited content, adding key examples:

• Content that disrupts multiplayer gameplay (e.g., intentional sabotage).
• Content containing graphic, explicit, harmful, or offensive material.

This stricter approach follows reported takedown incidents, possibly spurred by a controversy involving Splatoon 3. A video by content creator Liora Channel, featuring interviews with female players discussing dating within the game, was removed by Nintendo. Liora Channel subsequently pledged to avoid sexually suggestive Nintendo-related content.

The stricter guidelines are arguably a response to the increasing risk of predatory behavior in online games, particularly those targeting younger players. Instances like those reported in Roblox, where individuals have been arrested for exploiting online connections, highlight the need for proactive measures.
